Document 90, Copy of Mr Davidson's affidavit, 12 April 1788, p 2

if they were Justified & impowered so to do That the sd Mr
Heron then retired leaving the Dept with the sd Justices
& in a few Minutes this Dept was sent for by the sd Mr
Heron who delivered to this Dept a piece of paper
Whereon he sd he had Written the Mesage delivered by
him to the sd Justices & the Ansr which he recd thereto a
Copy of which is hereto annexed & Desired this Dept
to carry the same to the sd Justices to know if what was
this
contd in the sd paper was not right That Dept immedly
went in again to the Magistrates and after Acquainting them
with what Mr Heron had said read the sd paper to them
When they instantly said that what was contd in the sd
paper a copy of which is hereunto Annexed, was not a
Fair report of the matter because it wd appear
therefrom that they were averse or thought themselves
not justified in acceding to any proposals to be made
on behalf of the sd Mr Errington who for ought they knew
Question
might have to propose to rebuild the Bridge in ???
pay the money recovered at Law or procure an Act
of parliamt at his Expence, to justify their receiving
less This Dept was therefore requested to inform sd Mr Heron
that if it was agreed to the sd paper as the ? That
he declined to make a proposal unless the Justices wd
agree
declare they wd ??? thereto and they were well
disposed to receive and accede to proposals if they could
be authorized and impowered so to do Then what was so written
on the sd paper & what was to be added wd be realy the
draft of the Question and Ansr That this Dept Accordingly
went out to the sd Mr Heron & acquainted him in substance
as he had been directed when the sd Mr Heron replied he
in Question
Neither meant to propose to rebuild the Bridge pay
the money recovered at Law or procure an Act as
above Mendt but that he certainly wd Add that they
were well disposed to receive proposals if they could be
Justified in Acceding thereto And that [???]* they wd receive
