Exceptions taken by the said Complt to the Ansrs of the said Defts
John Tweddell and Bacon Wm Wastell put into yr said Complts
Bill of Complaint
1st Exception For that the sd Dfts John Tweddell and Bacon Wm Wastell
have not in and by their sd Ansr according to the best and utmost of
their respive Knowledge Remembrance Information & Belief answd
& set forth wher the Bridge in the sd Bill in that Behalf mentd
and which was built by ye sd Complt as therein set forth was not
so thrown down and destroyed as in yr said Bill mentd without
any previous appearance of any defect in the constructing or
building thereof or how and in what respect otherwise.
2nd Excon For that the sd Defts John Tweddell B.W. Wastell have not in
manner afsd ansd & set forth wher it was not for the reasons in ye sd Bill
for that purpose mentd be for the ultimate good & safety of the County of
Northland & its Inhabitants that a new Bridge upon a more extensive
and enlarged plan shd be erected & built capable of withstanding
any possible flood.
3rd Excon For that the sd Defts John Tweddell & B.W. Wastell have not
in manner afsd answd & set forth Wher the sd Complt did not actually
lay out & expend in erecting and building the Bridge in the sd Bill
mentd and in making & finishing the road thereto much more than
the sum of £5,700 besides the old matls as in ye sd Bill mentd And
wher it wod not so appear if an Account were taken of what was so
laid out and expended And wher ye sd Complt was not consibly
[and?] somewhat and how much out of Pocket on the Acct in ye sd Bill
set forth by building of ye sd Bridge.
4th Excon For that the sd Defts Jno Tweddell & B.W. Wastell have not in manner
afsd answd & set forth Wher in order to build a Bridge [ov?]er the river
Tyne capable of withstanding any possible Flood wch [ma?]y arise or such
a Flood as arose in the Month of March 1782 as in ye sd Bill set
forth a much greater [as?] same & what sum of money must not necessarily
be expended and laid out than what was allowed and paid to ye sd Complt
as in ye sd Bill mentd And wher such a Bridge must not & ought not
