Document 11, Case prepared on Mr Errington's behalf, undated, p 1

Case
A Bridge was built by Subscription across the River Tyne near Hexham in
Northumberland for the Use of the Public communicating with a Common High Way
and Was finished in the year 1770-in November 1771 it was thrown down
by a Great Flood and the County was [presented?]
The Justices Sensible of the great Utility to the public of a Bridge
across the said River at or near the Place aforesaid employed an eminent Engineer
to make a plan-They also published Advertisements for Undertakers and caused Several
Experiments to be made of the Foundations under the direction of the said Engineer
a Considerable Quantity of Materials was collected from the Ruins and some Now*
[???] prepared at the Expence of the County – but altho’ the advertisements
were continued for a Very long Space of Time, no person would undertake to Build
the Bridge either upon the Scite of the former one or at any other Place, till Mr
Errington having consulted with Mr Smeaton made a Proposal to the Justices to
Build the Bridge at a Place about half a Mile below the former.-
By Articles of Agreement dated 2 June 177[7?] made Between three of the
Justices of Northumberland of the one part and said Mr Errington of the other
[???]Reciting that at the General Quarter Sessions held by Adjournment the 6th
day of [???] last said Mr Errington proposed that he would for the Consideration after
mentioned Build and make a good and substantial Stone Bridge across the River Tyne
[???] from and to such place and of such Dimensions and in such Manner as in
[???] Articles and a Plan [thereunto?] annexed are particularly mentioned and
[???] the same should be Built under the Direction and Inspection of the
[???] and that Mr Errington would compleat the Whole and find & provide
All necessary Materials for the same over and above All the Timber Stone Iron & other
Materials whatsoever which had been prepared & provided as above (& which he was to
have) for the sum of £5,700-And further Reciting That at the said Sessions
